Beyond Equity: Why the Supreme Court’s Observation on Section 72 in Dr. M.K. Ravi Varma May Quietly Reshape Recovery Jurisprudence

A deep analysis of 2026 INSC 1080 – When statutory principle meets decades of equity-driven case law

Introduction

For nearly three decades, the law relating to recovery of excess payments made to government employees has been dominated by equity. From Sahib Ram (1995) and Shyam Babu Verma (1994) to Syed Abdul Qadir (2009), Rafiq Masih (2015), and Thomas Daniel (2022), the Supreme Court has largely approached the issue through the lens of hardship, fairness, and Article 142. The statutory foundation of unjust enrichment — Section 72 of the Indian Contract Act, 1872 — has remained almost invisible.

In Dr. M.K. Ravi Varma etc. etc. v. National Institute of Technology (2026 INSC 1080), a Division Bench of Justices Dipankar Datta and Sheel Nagu has, for the first time in this line of cases, openly acknowledged this silence. That acknowledgement, though made almost in passing, is the most significant aspect of the judgment.

Factual Background

Faculty members of the National Institute of Technology were granted Academic Grade Pay in October 2009. Within three months, the Institute realised that the grant was erroneous and withdrew the benefit, initiating recovery. At the time of pay fixation, the teachers had executed undertakings agreeing to refund any excess amount paid due to mistake. A Single Judge of the Kerala High Court protected the teachers from recovery. A Division Bench reversed that decision. The Supreme Court has now upheld the Division Bench.

Key Holdings of the Court

On the facts, the decision is unsurprising. Once an employee has given a clear undertaking permitting recovery, the protective categories carved out in paragraph 18 of State of Punjab v. Rafiq Masih (2015) 4 SCC 334 lose much of their force. This position was already settled in High Court of Punjab & Haryana v. Jagdev Singh (2016) 14 SCC 267. The Court correctly held that the payment was a pure mistake, promptly corrected, and that the teachers never claimed any independent legal right to the higher Academic Grade Pay.

Doctrinal Significance

The real value of the judgment lies in its doctrinal observation. In paragraph 15, the Court states:

“Curiously, not a single precedent has remarked on the applicability of Section 72 of the Contract Act, 1872; however, without referring to it, we find that the ratio of Chandi Prasad Uniyal draws inspiration from it.”

This is not a casual remark. It is a quiet but important observation on the manner in which this branch of law has developed.

Section 72 creates a clear statutory liability: money paid by mistake must be returned. Chandi Prasad Uniyal v. State of Uttarakhand (2012) 8 SCC 417 had already held that excess payment of public money can ordinarily be recovered to prevent unjust enrichment, subject only to limited exceptions of extreme hardship. Yet subsequent decisions, particularly Rafiq Masih, preferred to expand the hardship exceptions without engaging with the statutory principle that underpinned Chandi Prasad Uniyal.

Article 136 versus Article 142: A Crucial Distinction

The present Bench carefully notes that decisions such as Sahib Ram and Shyam Babu Verma were rendered in exercise of the Court’s powers under Article 142 of the Constitution and therefore do not have the same binding force under Article 141 as Chandi Prasad Uniyal. This distinction, first drawn by a three-Judge Bench in Rafiq Masih itself, had largely been ignored in subsequent practice. The Court has now brought it back into sharp focus.

Analytical Reflections

The judgment is restrained. It does not overrule Rafiq Masih or Thomas Daniel. It does not declare that Section 72 must now govern every recovery case. What it does is more subtle and, in the long run, more powerful: it exposes a conceptual gap.

For years, the Court has treated recovery of excess salary as a special category governed almost entirely by equitable considerations. The statutory principle of unjust enrichment was left unspoken. By naming Section 72 and linking it to Chandi Prasad Uniyal, the Bench has reminded the legal system that equity cannot permanently displace statute.

This has practical consequences. In future cases, employers — especially autonomous institutions and public sector bodies — can now more confidently rely on both the undertaking and the statutory principle under Section 72. Employees will find it harder to claim protection under Rafiq Masih merely by asserting hardship, particularly when they have signed recovery undertakings.

At the same time, the Court has left the door open for genuine cases of extreme hardship — for instance, where the entire excess amount has been spent on medical treatment and recovery would cause severe distress. The judgment does not shut the equitable window; it merely insists that the window must be opened only on proper pleadings and proof.

Concluding Remarks

Dr. M.K. Ravi Varma is not a dramatic judgment. It is an intellectually honest one. In an area of law that had become heavily equity-driven, the Court has quietly restored the relevance of a foundational statutory principle. Whether larger Benches will now engage more directly with Section 72 remains to be seen. But the silence has been broken.

That, more than the result on the facts, is why this decision deserves careful attention.
